2. THE SERVICE
As additionally detailed below, we process your personal information for various purposes related to the Service, including, but not limited to, providing the Service's functionality, fulfilling your requests, improving the Service, conducting research and analysis relating to the Service, personalizing your experience, monitoring usage of the Service, providing feedback to businesses listed on the Service, displaying advertising, providing customer support, communicating with you, maintaining system and data backups, enhancing the security of the Service, and complying with legal obligations.

If you exchange messages with ByMyHonor and/or others through the Service (e.g., direct messages, quote requests sent to businesses, AI chatbot communications, and similar features), we may collect and store them and any data associated with the message in order to process and deliver them and allow you to manage them. We may review and disclose messages and message data in connection with investigations related to your use of the Service. We may not deliver messages that we believe are objectionable, such as spam messages, fraudulent solicitations, or requests to post, exchange, modify or remove reviews or Honor Notes for compensation. If you make calls or send or receive SMS messages through the Service, we may log phone numbers, phone carriers, and the date and time that any calls or messages were processed. Carrier message and data rates may apply. We may also collect and store information that you provide through communications with us, including from phone calls, SMS, chats, letters, emails and other electronic messages, or in person. Any of our communications with you, including any phone calls or chats, may be monitored and recorded for quality purposes. If you are a representative of a business listed on ByMyHonor, or use a phone number associated now or previously with such a business, we may contact you, including by phone or email, using the contact information you provide us, make or made publicly available, or that we have on record for the business. |

7. MANAGING YOUR PERSONAL INFORMATION
Be mindful that visitors to the Service may be able to identify you, or associate you with your account, if you choose to include personal information in the content you post publicly. Your Honor Score and Validation Score becomes public information once you join ByMyHonor. ByMyHonor users can also use the search feature to find one another based on their names, account numbers or email addresses. Please also note that the messages you send or receive using the Service are only private to the extent that both you and the recipient(s) of your messages keep them private. For example, if you send a message to another user, that user may choose to share it. We may access, review, and disclose such messages in connection with investigations related to use of the Service or for purposes of improving the Service.
8. ARTIFICIAL INTELLIGENCE
We may use machine learning and other artificial intelligence (AI) technologies ("AI Technologies") to provide and improve our Service. For example, we may use such AI Technologies to analyze and process your contributions and interactions to provide you with personalized experiences, content recommendations, and relevant information based on your activity on ByMyHonor; develop new products and features; train or fine-tune AI models; provide interactive services such as AI powered chats, virtual assistants, and automated answering services for tasks and to help identify content that may violate our Content Guidelines and/or Terms of Service.
9. ACCOUNT CLOSURE AND DATA RETENTION
Information on how to close your account is available on the user account settings tab. When you close your account, we remove certain public posts from view and/or dissociate them from your account profile, but may retain information about you for the purposes authorized under this Privacy Policy and consistent with our data retention policy, unless prohibited by law. You can request that we delete personal information associated with your account. Please note that users cannot remove their pages, ratings, or honor notes by closing their accounts instantaneously. The delete account functionality and or delete Honor Note functionality requires a seven year count down upon delete request activation to remove a user account or delete and Honor Note. ByMyHonor retains information for as long as reasonably necessary for the purposes for which it was collected, or as otherwise permitted or required by law.
10. CHILDREN
ByMyHonor does not knowingly collect personal information from children, and our Service is not directed to children. Access or use of the Service by anyone under the age of 18 is not allowed. Please contact us by email to report the impermissible use of ByMyHonor Services by children. If we become aware that a child under 18, or under the applicable age of consent, has provided us with personal information without parental consent, we will take steps to remove such information and terminate the child's account.
11. SECURITY
We use various safeguards to protect the personal information ByMyHonor processes. However, no method of transmission over the internet or via mobile device, or method of electronic storage, is completely secure. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

13. MODIFICATIONS
We may modify this Privacy Policy from time to time. The current version of the Privacy Policy will govern our collection, use, and disclosure of information about you. If we make material changes to this Privacy Policy, we will notify you by email and/or by posting a notice on the Service prior to or on the effective date of the changes. By continuing to access or use the Service after those changes become effective, you acknowledge the revised Privacy Policy.
14. UNITED STATES RESIDENTS: YOUR PRIVACY RIGHTS
ByMyHonor does not sell your personal information and will not do so in the future without providing you with notice and an opportunity to opt-out of such sale as required by law. Similarly, we do not offer financial incentives associated with our collection, use, or disclosure of your personal information. ByMyHonor does not knowingly sell or share the personal information of consumers under 18 years of age.
Residents of certain states may have additional rights around ByMyHonor's collection, use, and sharing of their personal information. Information on state-specific privacy rights is available in ByMyHonor's U.S. State Privacy Rights Notice and the Washington My Health My Data Act Notice.
We do not disclose your personal information to third parties for the purpose of directly marketing their goods or services to you unless you request such disclosure.
ByMyHonor may engage in "targeted advertising" as that term is defined by applicable law. Residents of certain states have the right to opt-out of targeted behavioral advertising, which you can do on your user profile settings tab. We also recognize Global Privacy Control opt-out signals enabled through your browser in states where we are required to do so by law.

Section 6 (Data We Share With Third Parties) describes the categories of third parties with whom we share personal information, and what information may be shared under different circumstances.
15. EUROPEAN RESIDENTS: YOUR PRIVACY RIGHTS
If you are a European Resident, you have the right to access your personal data, and the right to request that we correct, update, or delete your personal data. You can object to the processing of your personal information, ask us to restrict processing of your personal information, and request portability of your personal information.
Similarly, if we have collected and processed your personal information with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your personal information conducted in reliance on lawful processing grounds other than consent. The Service generally provides you with a reasonable means to view and change your profile information and you can opt-out of marketing communications at any time by clicking on the "unsubscribe" or "opt-out" link in the marketing emails we send you or in your account settings. For European Residents, please note that the personal information we obtain from or about you may be transferred, processed, and stored outside of the EEA, UK, or Switzerland for the purposes described in this Privacy Policy, including in the United States of America.
We take the privacy of our users seriously and therefore take steps to safeguard your information, including ensuring an adequate level of data protection standards in effect as of the date of this Privacy Policy. These steps include use of Standard Contractual Clauses for transfers of personal information between our group companies, which require all group companies to protect European Residents' personal information in accordance with applicable data protection laws. We have implemented similar appropriate safeguards with our third-party service providers and partners and further details can be provided upon request.
For European Residents, our legal basis for collecting and using the information described in Section 3 of this Privacy Policy (Data You Share With Us) will depend on the specific information concerned and the context in which we collect it. We, however, will normally collect personal information from you only where we have your consent to do so, where we need the personal information to perform a contract with you, or where the processing is in our legitimate interests and not overridden by your data protection interests or fundamental rights and freedoms. In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person (for instance, to prevent, investigate, or identify possible wrongdoing in connection with the Service or to comply with legal obligations or to ensure you are the person you claim to be).
